These Terms of Service ("Terms") govern your use of the Summit Training iOS application and the Summit web application, including this website, and related services (collectively, the "Services") provided by Summit Training.
By creating an account or using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under 18 you must have a parent or legal guardian's permission.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activity that occurs under your account.
3. Medical Disclaimer
The Services are not medical advice. Summit Training is a fitness and strength-training tool. The programs, exercises, and calculations provided through the Services are for informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.
Powerlifting and strength training carry inherent risks of serious injury, including muscle strain, joint injury, spinal injury, and in rare cases, death. Consult a qualified physician before starting any new training program, especially if you have any pre-existing medical condition or injury.
You assume all risk of injury. You agree that Summit Training, its employees, coaches, and affiliates are not liable for any injury, illness, or damage resulting from your use of the Services.
4. Coach-Athlete Relationship
When you connect to a coach using an invite code, you authorize your coach to view your training data, communicate with you through the Services, and modify programs assigned to you. Coaches are independent users of the Services; Summit Training does not employ coaches and does not verify their credentials or qualifications. You are solely responsible for evaluating whether a coach is appropriate for you.
5. Subscriptions and Billing
Certain features of the Services require a paid subscription. Subscriptions are processed by Apple through the App Store.
Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Managing Subscriptions. You can manage and cancel subscriptions through your Apple ID account settings. Deleting the app does not cancel your subscription.
Refunds. All purchases are handled by Apple and are subject to Apple's refund policy. Summit Training cannot issue refunds directly.
Price Changes. We may change subscription prices from time to time. We will give you at least 30 days' notice before a price change takes effect. You can cancel before the new price applies.
6. Acceptable Use
You agree not to:
- Use the Services to violate any law or regulation.
- Upload content that is unlawful, harassing, defamatory, obscene, invasive of another's privacy, or infringes intellectual property rights.
- Impersonate any person or entity.
- Interfere with or disrupt the Services or servers connected to them.
- Attempt to gain unauthorized access to any part of the Services.
- Reverse engineer, decompile, or disassemble the Services.
- Use automated systems (bots, scrapers) to access the Services.
7. User Content
You retain ownership of content you upload (videos, voice messages, notes, programs). By uploading content you grant Summit Training a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and transmit that content solely to provide the Services to you and your connected users (such as your coach or athletes).
You are responsible for the content you upload. Summit Training has no obligation to pre-screen content but may remove content that violates these Terms.
8. Intellectual Property
The Services, including all software, text, graphics, logos, and trademarks, are the property of Summit Training or its licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
9. Third-Party Services
The Services integrate with third-party services including Apple, Google, Supabase, Anthropic, Sentry, and Vercel. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
10. Termination
You may terminate your account at any time through the in-app account deletion flow or by emailing legal@summittraining.app.
We may suspend or terminate your access to the Services, with or without notice, if we believe you have violated these Terms, if required by law, or for any other reason in our sole discretion.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Summit Training and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or relating to these Terms or the Services.
Our total liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid us in the 12 months preceding the claim, or one hundred US dollars (US $100), whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold harmless Summit Training from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your content, or your violation of these Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property or confidentiality matters.
You agree that any claim must be brought on an individual basis and not as part of a class action.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version in the app and update the "Effective" date. Material changes will be announced with a notice in the app at least 7 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
